Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Dirt Cheap Labs ("Dirt Cheap Labs", "we", "us", or "our") covering your use of dirtcheaplabs.xyz and any service we offer through it (the "Service"). By using the Service, placing an order, or paying, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility (you must be 18 or older)

You must be at least 18 years old and a resident of the United States to use the Service. By placing an order you confirm that you are 18 or older, that the information you give us is true, and that you are ordering tests for yourself. The Service is not for minors. We do not knowingly sell to anyone under 18.

2. What the Service is, and what it is not

Dirt Cheap Labs lets you choose lab tests (one of our flat-price panels or individual tests from our catalog), pay once, and receive a lab requisition. You take that requisition to a Quest Diagnostics location and get your blood drawn. Your results come back to you as a PDF.

The Service is a way to order and pay for lab testing. It is not a doctor's visit, a diagnosis, a treatment plan, or medical advice. We do not interpret your results, tell you what they mean for you, or tell you what to do about them. We are not your doctor and using the Service does not create a doctor-patient relationship between you and Dirt Cheap Labs. See the Informed Consent section, which you also agree to when you order.

3. No doctor visit, and how ordering works

You do not see or speak to a doctor to use the Service. So that your tests can be ordered lawfully, your lab order is authorized through a licensed physician network arranged by our lab-ordering partner. You are not that physician's patient, they do not evaluate you, and they do not provide you care or advice. Their role is limited to authorizing the lab order so the lab can run it. No physician-patient relationship is created.

4. The role of Quest and our lab-ordering partner

We work with third parties to deliver the Service. Quest Diagnostics performs the blood draw and runs the lab tests at its locations. Our lab-ordering partner provides the technology that places your lab order with the physician network and the lab and returns your results to us. When you get drawn at Quest, you are also subject to Quest's own terms and privacy practices, which are separate from ours. We do not control Quest's facilities, staff, scheduling, or lab operations.

5. State availability

The Service is available only where direct-to-consumer lab testing is permitted. Some states regulate self-ordered lab testing and billing arrangements in ways that prevent us, or prevent Quest, from serving residents of those states, so the Service cannot be fulfilled in some states. If your address is in a state where we cannot serve you, we will not be able to complete your order.

6. Ordering, pricing, and payment

The price shown at checkout is the price you pay for the tests you selected. Payment is processed by Stripe, our payment processor. We do not store your full card number. By placing an order you authorize us, through Stripe, to charge your payment method for the amount shown. Your order is confirmed when payment succeeds and we send your requisition. We may decline or cancel an order if we cannot lawfully fulfill it (for example, a restricted state) or if we suspect fraud or misuse.

7. Refunds and cancellation

You can cancel an order and request a refund any time before you have your blood drawn at Quest. Once your blood has been drawn, the order is final and cannot be refunded, because the lab work has begun. To cancel, contact us at orders@dirtcheaplabs.xyz with your order number before you go to the lab. Refunds are returned to your original payment method and may take several business days to appear.

If you live in a state that restricts self-ordered testing and you ordered anyway, we cannot guarantee a refund, and you may need to travel to a state where testing is permitted to get drawn.

8. Acceptable use

You agree to use the Service only for lawful purposes and only for yourself. You agree not to: give false information, order on behalf of someone who has not consented, resell or commercialize the Service, attempt to access accounts or data that are not yours, scrape or copy the catalog or pricing, interfere with or probe the site's security, or use the Service in any way that violates applicable law. We may suspend or terminate your access if you break these rules.

9. No warranties

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or that any result will be delivered within a specific time, since draw scheduling and lab turnaround are handled by Quest and the lab. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy of lab results, which are produced by the lab, not by us.

10. Limitation of liability

To the fullest extent allowed by law, Dirt Cheap Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of profits, or personal injury, arising out of or related to your use of the Service, your lab results, the interpretation or misinterpretation of those results, any action or inaction you take based on them, or the acts of Quest, our lab-ordering partner, or the ordering physician. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the order that gave rise to the claim. Some states do not allow some of these limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Dirt Cheap Labs and its operator from any claim, loss, or expense (including reasonable attorney fees) arising from your use or misuse of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the date at the top and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by applicable United States and state law. Any dispute relating to the Service will be resolved as permitted under that law.
